Terms of Service

By creating an account or using MesaDash Inc., you agree to these Terms. If you use it for a business, you confirm you have authority to bind that business.

1. Service

MesaDash Inc. operates MesaDash in Nigeria. These Terms govern our software for restaurants, salons, spas, barbers, other appointment businesses and carwashes, including storefronts, orders, bookings, teams, customer support and payment connections. Enabled integrations may include WhatsApp Business App or Business Platform, Instagram, Messenger, Telegram, Google Calendar and payment services. Features vary by plan, country, permissions and connection type. Product-specific responsibilities below apply when that product is used.

2. Accounts and Workspaces

You must provide accurate account and business information, have authority to act for the business, protect credentials and control staff access. You are responsible for authorized activity by your users and integrations and must promptly report suspected unauthorized access. You must have permission to connect each messaging account, calendar and payment service.

3. Business Customer Data

For messages, orders, customers, bookings, catalog data, and similar workspace records, the business is responsible for having the required privacy notices, consents, lawful basis, opt-outs, and customer permissions. MesaDash Inc. processes that data to provide the service and follows documented workspace instructions unless law requires otherwise.

4. Data Processing Agreement

Where data protection law requires a processor contract, these Terms and any applicable Data Processing Addendum govern MesaDash Inc.'s processing of business customer data. MesaDash Inc. will use appropriate security measures, limit access, use subprocessors only as needed for the service, assist with reasonable rights requests where possible, and return or delete customer data according to lawful instructions and retention requirements.

5. Connected apps and messaging rules

You must comply with the terms and policies of every connected provider, including applicable Meta, WhatsApp, Instagram, Messenger, Telegram and Google rules, commerce restrictions, message permissions and opt-out requirements. Do not use MesaDash for spam, illegal goods, fraud, harassment or unlawful discrimination. Providers may restrict accounts, reject messages or change access. Connection does not guarantee approval, message delivery or synchronization. Revoking or disconnecting access does not itself erase historical records, cancel orders or refund payments.

6. Email and Marketing Compliance

If you use MesaDash Inc. to send commercial or promotional communications, you must avoid misleading sender or subject information, identify commercial messages where required, include any required business address, and honor opt-out requests. Transactional and relationship messages must still be accurate and lawful.

7. Billing and Subscriptions

Subscriptions apply to business workspaces. The checkout or agreed order specifies the price, currency, billing period, taxes, plan limits and any trial or recurring billing terms. Recurring charges require the applicable authorization. Use the available billing controls or contact hello@mesadash.app for cancellation or billing assistance; cancellation of a MesaDash subscription is separate from a customer order or booking. Refunds and cancellation rights are subject to applicable law and any more favorable agreed terms. We will give notice of material price or subscription changes as required by law. Expiry or nonpayment may restrict paid features.

8. Security

Protect credentials, API keys, devices, payment accounts and connected-app permissions. We may restrict access where reasonably necessary to address abuse, security threats, nonpayment or unlawful activity. Contact hello@mesadash.app to report a security concern or dispute a restriction. Immediate restrictions may be necessary for urgent risks or legal requirements.

9. Availability and Changes

Features may change because of maintenance, provider requirements, security or legal obligations. We will give reasonable notice of material changes affecting paid services where practicable and any notice required by law. Unless expressly agreed, no particular uptime or support response time is guaranteed. These provisions do not remove mandatory service-quality obligations.

10. Liability

To the maximum extent allowed by law, MesaDash Inc. is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages. Nothing in these Terms limits liability where the law does not allow limitation.

11. The business and its customers

The business identified on a storefront, order or booking is responsible for the goods and services it offers, accurate prices and descriptions, taxes and fees, required licences, its staff, and fulfilment. It must disclose its identity, contact details, total charges and applicable cancellation and purchase conditions before a customer commits. MesaDash provides software; that alone does not make it the seller, treatment provider or delivery operator. Each party remains responsible for its actual role and conduct under applicable law.

12. Restaurants and food orders

Restaurants are responsible for food preparation, safety, hygiene, accurate menu and allergen information, availability, packaging, substitutions and their pickup or delivery arrangements. Customers should confirm allergies and dietary requirements directly with the restaurant. Automated information does not replace that confirmation. The restaurant handles missing, incorrect or late orders, food-quality complaints and required remedies. Delivery estimates are estimates and do not remove obligations under law or the accepted order.

13. Salons, spas, barbers and appointments

The appointment business is responsible for its professionals' qualifications where required, hygiene, service suitability, required consultation or consent, accurate descriptions and safe performance. It must disclose deposits, cancellation, rescheduling, lateness and no-show conditions before booking. Customers should discuss allergies, contraindications and relevant requirements directly with the professional. MesaDash does not provide treatment or clinical advice. Service-quality complaints, injuries and refund requests should be raised with the business; statutory remedies remain available.

14. Carwashes and vehicle services

The carwash is responsible for describing the service, vehicle eligibility, prices, add-ons, safe handling, its personnel and any agreed custody of keys or vehicles. It must communicate relevant inspection, valuables, access and collection arrangements before service. Customers should report existing damage and relevant vehicle instructions; the business should document condition where appropriate. Damage, missing-property and service-quality complaints should be reported promptly with available evidence. Neither an inspection nor a request to remove valuables automatically waives liability or statutory rights.

15. Customer support and disputes

For an order, appointment, treatment, vehicle service, delivery, cancellation or purchase refund, contact the business using its storefront or confirmation details. Include the reference, date, issue and requested remedy. The business must investigate and respond within applicable legal time limits. For MesaDash technical, account, subscription, privacy or security issues, contact hello@mesadash.app. If a business cannot be reached or you suspect misuse, you may also report it to us. We may request records, contact the business or assist communication; this does not guarantee a refund or make us the final adjudicator. Do not send passwords, one-time codes or full card details. Your rights to payment-provider disputes, the FCCPC or another competent regulator, and courts remain available.

16. Customer payments, deposits and refunds

Payments for merchant goods or services are separate from MesaDash subscription fees. The business must disclose the amount, recipient and applicable payment, deposit and refund conditions. Payment processing and settlement depend on the selected provider and payment method. The party responsible for the transaction must handle refunds and chargeback evidence with the provider as required. A payment confirmation does not by itself prove fulfilment. No blanket non-refundable condition overrides applicable consumer rights.

17. Automation and AI

Businesses must review enabled automation, generated content and workflow settings and provide a route to human assistance. AI responses can be inaccurate, including about service suitability, allergens or availability. Customers should seek confirmation from the business on material details. Using automation does not remove either party's legal responsibilities. Related data processing is described in the Privacy Policy.

18. Content and permitted use

You retain your rights in content you supply and grant us the permissions necessary to host, process, display and transmit it to provide the service and follow lawful instructions. You must have the necessary rights to customer data, images, logos and other material you upload. These Terms do not transfer ownership of MesaDash software or branding to you.

19. Ending use and records

You may stop using MesaDash and request account closure or data assistance at hello@mesadash.app. Ending use does not automatically cancel a provider subscription, merchant order or booking; request the relevant cancellation separately. Amounts lawfully due remain payable, subject to applicable remedies. Data return and deletion are handled according to applicable law, processing agreements and the retention purposes described in the Privacy Policy.

20. Nigerian law and legal rights

Subject to mandatory applicable law, these Terms are governed by Nigerian law. Contact hello@mesadash.app to seek resolution of a dispute with MesaDash. This does not postpone legal deadlines, require you to waive consumer or privacy rights, or prevent regulator complaints, urgent relief or proceedings before a court with jurisdiction. Product-specific provisions apply alongside the shared Terms and cannot override mandatory protections.
